(1.) By this judgment Cri. Revision No. 1696 and 1769 of 1987 are being disposed of simultaneously. In connection with an incident of 28-5-1982 revisionists Barameshwar Singh and Ajit Kumar Singh have been convicted by the lower Court with offence under Sec. 323, I. P C. and have been sentenced to rigorous imprisonment for 6 months and fine of Rs. 500.00 each. Principal accused of the case, who, according to the prosecution story initiated the occurrence, namely Vijai Kumar has already been given benefit of doubt and acquitted by the lower appellate Court. Revisionists are youngmen and it is urged on their behalf that they have recently joined as Lekhpals. Short term sentences do not serve any useful purpose. I think it is a fit case for granting first offenders benefit to the revisionists. Hence I partly allow these revisions and set aside the sentences of the revisionists. They are on bail. They shall be summoned by C. J. M. Ballia and shall be required to furnish their personal bonds with one surety each for maintaining peace and being of good behaviour for a period of one year. It may be mentioned that the offence was committed before the revisionists entered into service. It may be further added that the offence does not involve moral turpitude and so need not be a ground for their termination, removal or dismissal from service. Revision pPartly allowed.
