(1.) Heard learned counsel for the revisionist and learned A.G.A. Learned appellate court has confirmed conviction of revisionist Suraj Pal and one jalil for offence under Sec. 324/34 I.P.C. But it reduced the sentence to rigorous imprisonment for three months. The two lower appellate courts have not assigned any reason for not granting first offenders benefit to Suraj Pat and Jalil. Short sentences do not serve any useful purpose. On the other hand they cause dis-service to the Society by placing the accused in jail in the company of hardened criminals. Both the revisionists Suraj Pal and Jalil have already been in jail for about two months. This is a fit case for interference at this very stage. Hence admitting the revision on the point of sentence only. I allow this revision in part and set aside the sentence of the revisionist Suraj Pal. He is granted first offenders benefit under Sec. 4 of the U.P. First Offender's Probation Act. He shall be released on probation on his furnishing a personal bond for his good behaviour and maintaining peace for six months to the satisfaction of CJ.M, Fatehpur. Benefit of this order shall flow to co-accused Jalil also. During the period of probation their conviction shall remain suspended. A copy of this order be issued to the revisionists- counsel on payment of usual charges within 24 hours.
