JUDGEMENT

(1.) I have heard the learned counsel for the petitioner and also Sri B. Dikshit learned counsel for respondents. A preliminary objection bat been raised by Sri Dikshit that the petitioner has an alternative remedy against the impugned order under Sec. 128 of U. P, Cooperative Societies Act. He has supported his contention by a decision reported in W. P. No. 2076/1989 dated 10-3-1989, reported in (1991) 1 UPLBEC 32 (DB), V.K.S. Chauhan Vs. U.P. Cooperative Spinning Mills Federation. In view of the Divisk n Bench judgment 1 am of the opinion that the petition should fail on the ground of alternative remedy under Sec. 128 of the Act. This petition is accordingly dismissed.

(2.) In case petitioner approaches the Registrar under Sec. 128 of U. P. Cooperative Societies Act the Registrar shall decide the same expeditiously as far as possible within three weeks. Petition allowed.
