JUDGEMENT

(1.) By means of this writ petition the petitioner has challenged the recovery proceeding which is alleged to be electricity dues.

(2.) One of the ground for challenge is that the recovery certificate has been issued against the erstwhile owner of the premises namely S.B. Chatarji who is a dead person. At present the premises is in the name of petitioner who is currently consuming the electricity and against him an allegation of theft has been made.

(3.) As such, the recovery citation dated 14.3.2019, which is being pressed against the petitioner but in fact is in the name of S.B. Chatarji, a dead person cannot be sustained and it is hereby quashed with liberty to the respondent no. 2 to proceed against the petitioner afresh in accordance with law.
