JUDGEMENT

(1.) Application along with affidavit filed by the learned counsel for the revisionists, is taken on record.

(2.) This revision has been preferred against the judgment and order dated 14.08.1997 passed by the learned Sessions Judge, Mathura in Criminal Revision No. 266 of 1997 (Khoobi Ram Versus State), arising out of Case No. 23 of 1997 (Khoobi Ram and others Versus Raghunath and others) pending in the Court of S.D.M., Mathura, whereby learned District and Sessions Judge, Mathura has allowed the Revision by setting aside the order dated 31.07.1997 passed by the S.D.M., Mathura and matter was remanded back to S.D.M., Mathura.

(3.) Heard Sri S.S. Sharma, learned counsel for the revisionists and learned A.G.A. for the State. None has appeared on behalf of the opposite party no.2 ,3 and 4.
