(1.) Heard Sri Basant, petitioner in person and Sri Rajnish Kumar Rai, learned counsel for the respondents.

The brief facts of the case are that petitioner preferred Original Application No.1346 of 2003 before the Central Administrative Tribunal, Allahabad (hereinafter referred to as ''Tribunal') contending inter alia that the petitioner was appointed on 11.04.1969 as Junior Reader and was,thereafter, promoted on Group-C post. The petitioner was promoted on ad-hoc basis in Group-B category on 19.01.1981 and was posted as Assistant Superintendent, Printing and Stationery, North Eastern Railway, Gorakhpur. The petitioner was given regular promotion on Group-B post on 05.04.1983. Subsequently, the petitioner was, promoted in Senior Scale and was appointed as Senior Stores Officer in stores cadre w.e.f. 01.09.1988 of North Eastern Railway, Gorakhpur. The petitioner was promoted in Group-A/Senior Scale vide notification No.E(GP) 96/1/23 dated 28.01.1997.

The Indian Railways, Department for Printing and Stationery (Group-A Posts) Recruitment Rules, 1984 (hereinafter referred to as ''Rules 1984') provides that 40% vacancy of Group 'A' post should be filled up by promotion from Assistant Superintendent, Printing and Stationery with 8 years regular service in posts in scale of 650-1200 or equivalent besides other educational qualification prescribed in the Rules, 1984.
