JUDGEMENT

(1.) Supplementary affidavit filed today is taken on record.

(2.) Heard Sri Pranjal Krishna along with Sri Ashish Kumar Jain, learned counsel for the applicant and Sri S.B. Pandey, learned Senior Advocate assisted by Sri Varun Verma, learned counsel appearing for the respondent, through video conferencing in terms of orders passed by Hon'ble Chief Justice taking into consideration COVID-19 situation.

(3.) The present bail application has been filed by the applicant. It is contended that the applicant was working as a Postal Assistant who retired on attaining the age of superannuation on 31.01.2014. An F.I.R was lodged subsequent to the retirement of the applicant on 28.08.2014, a copy of which is annexure 3 to the bail application. The F.I.R was lodged by name against six persons pertaining to a fraud having been committed in the Postal Department at Lalitpur Head Post Office. Though the applicant was not named in the F.I.R yet his name came up in the charge sheet dated 30.06.2017, a copy of which is annexure 4 to the bail application which was filed subsequent to the investigation carried out by the police. The name of the applicant finds place in paragraph 106 of the charge sheet whereby it has been contended that the accused applicant Sri Hariom Tripathi who worked for a period of three days as Supervisor/ Assistant Post Master (Savings Bank) accepted identification of fake witnesses and passed forged vouchers for payment of fake withdrawal vouchers deliberately with ulterior motive of a total amounting Rs. 8,10,000/- from Government Exchequer to commit the fraud.
