JUDGEMENT

(1.) Heard Mr. Ashish Kumar Gupta, learned counsel for applicant, learned A.G.A. representing opposite party no.1 and Mr. V. K. Baranwal, learned counsel representing opposite party no.2.

(2.) This application under Section 482 Cr.P.C. has been filed for quashing of entire proceeding in Complaint Case No.2941 of 2012 (Vinod Kumar Vs. Akhtar Ali) u/s 138 of Negotiable Instrument Act, P.S. Jaitpura District Varanasi pending in the court of Addl.Chief Judicial Magistrate Court No.10. Varanasi.

(3.) It seems that in order to explore the possibility of an amicable settlement between the parties, the matter was referred to undergo mediation proceedings. The report of Mediation Centre dated 21.5.2013 reveals that the aforesaid attempt could not succeed and did not bear any fruit for certain reasons. The Court, therefore, deems it fit to decide the matter on merits.
