JUDGEMENT

(1.) Learned counsel appearing before us made an application that this matter is pending and likely to be heard by the Armed Forces Tribunal. We have gone through Section 34 of the Act which is meant for transfer of pending cases as follows:

Having such incorporation under Section 34 the sentence "stand transferred on that date to such Tribunal" means that the Court should transfer all such matters immediately by virtue of such provision of the Act. Therefore, the matter, which is required to be considered by the Tribunal, will be treated as transferred to it immediately as a consequential effect and Registry will show such type of matters as disposed of in the list of disposal of this Court.

(3.) The application is accordingly disposed of. No order is passed as to costs.
