JUDGEMENT

(1.) Heard Sri Amit Jaiswal, leanred counsel for the petitioner and Sri Rakesh Srivastava, learned Standing Counsel on behalf of respondents.

(2.) Sri Amit Jaiswal, learned Counsel for the petitioner, at the outset submits that the controversy which is involved in the present writ petition is already concluded by the decision given by this Court in number of cases namely one of the same is Writ Petition Nos. 5088 (MS) of 2010 Babu Banarsi Das National Institute of Technology and Manag. v. State of U.P. and Anr. in which this Court vide judgment and order dated 27.08.2010 disposed of the writ petition with the following direction:

(3.) Sri Amit Jaiswal, learned Counsel for the petitioner further submits that in the interest of justice, the present writ petition may also be disposed in terms of the aforesaid judgment. Sri Rakesh Srivastava, learned Standing Counsel has no objection to the said facts.
