JUDGEMENT

(1.) Heard Sri Bhagwati Prasad, learned counsel for the petitioner and Sri R.C. Gupta for the respondents.

(2.) The petitioner has prayed for a writ of mandamus commanding the respondents to treat the petitioner in service as a Routine Grade Clerk and not to interfere in the discharge of his duties as such. The respondents were called upon to file a counter-affidavit which has been filed and sworn by Mr. L.P. Sinha, Assistant Manager, Legal Cell, U.P. Jal Nigam.

(3.) Sri R.C. Gupta has invited the attention of the Court to the said counter- affidavit; a copy whereof was served on the learned counsel for the petitioner on 25.2.1999. The contents of the said counter-affidavit have not been denied.
