JUDGEMENT

(1.) HEARD learned Counsel for the applicant and learned A.G.A. for the State -respondent.

(2.) THIS Court vide order dated 30.4.1991 had issued notice to the opposite party to file counter affidavit and in the mean time further proceedings of Case No. 1134 of 1990, under Sections 406, 420 IPC, pending before the Additional Chief Judicial Magistrate, Hapur, were stayed.

(3.) THE present 482 Cr.P.C. petition has been filed for quashing the proceedings of Case No. 1134 of 1990, Bharat Textile v. Brij Lal, under Sections 406, 420 IPC, pending before the Additional Chief Judicial Magistrate, Hapur. The contention of the counsel for the applicant is that no offence against the applicant is disclosed and the present prosecution has been instituted with a malafide intention for the purposes of harassment. He pointed out certain documents and statements in support of his contention.
