JUDGEMENT

(1.) By the Court. Heard Mr. Ved Byas Misra,learned counsel for the appellant- University and Mr. A.K. Tripathi,learned counsel for the respondent-petitioner Shanti Pandey,who has described herself as Principal,Jageshwari Kedat Tiwari Pracharya Vidyapeeth,Devradh Kalan,Post Kevdh-Dudra,Kaimoor,Bihar.

(2.) The University has come up in appeal against the directions issued by the learned Single Judge while disposing of the writ petition filed by the respondent, allowing the students, who were being represented by the Principal of the College, to appear in the fresh examinations and for that, the learned Single Judge passed an order that the Registrar of the University, shall conduct fresh examinations for the students, who had been left out in the main examination of the year 2008-09 within a month from the date of production of certified copy of the order.

(3.) The University has questioned the correctness of the impugned judgement in this appeal. This Court passed an elaborate interim order staying the operation of the said judgement after noticing certain glaring facts worth consideration. The said interim order is as follows :
