JUDGEMENT

(1.) HEARD learned Counsel for the applicant and learned A.G.A.

(2.) ANOTHER Bench of this Court vide its order dated 17.08.998 had issued notice to the opposite party No. 2 and in the meantime stayed the further proceedings of Case No. 39 of 1998, under Sections 387, 323, 504 I.P.C., and Section 3(1)(10) SC/ST Act, pending before learned Special Judge, (D.A.A.), Jhansi.

IT is contended by learned Counsel for the applicant that from a bare perusal of the F.I.R., as well as statements recorded under Sections 161 Cr.P.C., would demonstrates that no offence under Section 387 I.P.C., is made out against the applicant. It is further contended that no offence against the applicant is disclosed and the present prosecution has been instituted with a malafide intention for the purposes of harassment. He pointed out certain documents and statements in support of his contention.
