JUDGEMENT

(1.) These revisions arise out of judgment and order dated 6.5.85 passed by IV Additional Sessions Judge, Meerut dismissing the appeals preferred by accused Tahir and Mohammad Yunus against the judgment and order dated 28.10.83 passed by Judicial Magistrate in Court No. 1, Meerut convicting the accused under Sec. 7/16 of the Prevention of Food Adulteration Act and sentenced them each to undergo rigorous imprisonment for six months and to fine of Rs. 1000.00.

(2.) Heard learned Counsel for the revisionist and learned A.G.A.

(3.) After having gone through the judgments and the record and submission of learned Counsel for the parties, I do not find any merit as far as conviction is concerned. The revisionist Mohd. Yunus was found selling adulterated ice-candy. On analysis it was found to have been sweetened with Saccharine used of which was not permitted in ice-candy.
