JUDGEMENT

(1.) S. P. Pandey, J. This is an ap plication for transfer the case pending in the Court of Additional Commissioner, Varanasi Division Varanasi to the Court of Commissioner Azamgarh Division Azam garh.

(2.) HEARD the Court and perused the paper counsel for both she panicles for the parties file. The Counsel omitted that the c Additional Com Division Varanasi be transferred to the Court of Commissioner Azamgarh Division Azamgarh as the apace pending missioner, Varanasi plieant is the resident of district Ballia Azamgarh and the O. P. Sita Ram Singh is also resident of District Ballia Azamgarh and the disputed land is situate in district Ballia as such the case should be transferred to Azamgarh Division, Azam garh.

(3.) IN consequence, this transfer ap plication is accordingly allowed and the case pending before the Court of Addi tional Commissioner Varanasi Division Varanasi is accordingly ordered to be transferred to the Court of learned Com missioner Azamgarh Division, Azamgarh. Application allowed. .
