JUDGEMENT

(1.) THIS is a reference made by learned Additional Commissioner, Jhansi by his order dated 4-7-98 passed in revision No. 38/15 of 96-97 district Mahoba recommending that the revision be allowed and the order of the trial Court dated 1- 3-97 be set a side.

(2.) I have heard the learned Counsel for the parties and perused the record.

(3.) IN view of the above revision is allowed and the order of the trial Court dated 1-3-97 is set aside. Revision allowed
