JUDGEMENT

(1.) This revision is directed against the judgment and order dated 4.3.87 passed by IV Additional Sessions Judge, Ghazipur dismissing the appeal preferred against the judgment and order dated 2.5.86 passed by Special Judicial Magistrate, Ghazipur convicting him under Sec. 7/16 of the Prevention of Food Adulteration Act and to fine of Rs. 1000.00.

(2.) The learned Counsel for the revisionist has pressed this revision on the question of sentence. The alleged adulteration was made in the year 1985. More than 15 years has elapsed.

(3.) Considering the nature of the accusation and facts and circumstances of the case I am of the view that the ends of justice require that the revisionist may not be sent to jail.
