JUDGEMENT

(1.) S. P. Pandey, J. This is a review petition preferred against the order dated 22-12-1998 passed by this Court in second appeal No. 23 of 1994-95/bijnor ' with the prayer that the aforesaid order be set aside. In the facts and circumstances of this ease this review petition is being dis-posedof finally at the admission stage.

(2.) I have heard the learned Counsel for the parlies and have also perused the record. For the review petitioner, it was sub mitted that the aforesaid order has been passed without touching any documentary evidence on record which is illegal improper and perverse on the face of the record and is liable to be set aside that this Court had failed to decide the case in accordance with law and rules. The learned Counsel for the opposite party urged that the aforesaid impugned order is quite just and proper which must be maintained.

(3.) IN consequence this'review peti tion having no force is accordingly dis missed. Stay order if any is - also here by vacated. Let records be returned forthwith to the Courts concerned. Review dismissed .
