JUDGEMENT

(1.) THIS second appeal has been filed by Heera Lal against the judgment and decree dated 6-7-92 passed by learned Additional Commissioner, Jhansi Division, Jhansi in Appeal No. 24/23 of 1990-91/Hamirpur. By the impugned order the learned Additional Commissioner allowed the appeal, set aside the order of the trial Court and dismissed the suit of the plaintiff.

(2.) I have heard the learned Counsel for the parties and perused the record carefully.

(3.) AFTER a careful perusal of the material on record I am inclined to agree with the view taken by the Court of first appeal. The learned trial Court was not justified in decreeing the suit of the plaintiff which deserved to be dismissed. The order of the learned Additional Commissioner is correct and deserved to be maintained.
