JUDGEMENT

(1.) MANMOHAN Singh respondent is permanent resident of House No. WM -224/A, Basti Guzan, Bagh Ahluwalia, Jalandhar which falls in the jurisdiction of the Municipal Corporation, Jalandhar i.e. the appellants. He is a retired police Head Constable. He has been making the payment of sewerage/water charges to the appellants against account No. MC -58/L and 58/235 having ID No. 66416. The last bill paid by the appellants was on 8.4.2006.

(2.) IT was further pleaded that there exists one 120 feet road near the house of the respondent. The sewerage pipe was commissioned to cater to the need of Ram Nagar locality via 120 feet road which further leads to Urban Estate Disposal Canter, It was 69 inches in width. It was inadequate to carry out the disposal of the sewerage of the above areas. Consequently because of the pressure exerted on the said pipe, it often remained choked and started making backflows.

IT was further pleaded that instead of making proper arrangement and widening the size of the said sewerage pipe the appellants had broken one of the chambers of the sewerage pipe near the Municipal park built adjacent to 120 feet road, Jalandhar. Because of the breakage of the sewerage chamber, the entire locality of Basti Guzan, Bagh Ahluwalia was filled with the sewerage water. The sewerage water entered even the house of the respondent and other adjoining houses. The sewerage water also remains stagnant in the street and every phase of the locality remains under the sewerage water. As a result the foul smell of sewerage has made the life of the respondent and his family members miserable.
