(1.) THE respondent had applied to the appellants for tubewell electric connection on 9.3.2006 on priority basis as Ex -serviceman. The connection was approved by the appellants. The respondent installed the motor, bore, etc. as per the requirements of the appellants. The appellants demanded the test report which was submitted by the respondent. It was approved by the appellants. They had taken the work in hand and installed the pole and wiring, etc. The respondent had also completed the remaining formalities within the specified period from the demand notice. However, the electric connection has not been released to the respondent.
(2.) IT was further pleaded that the appellants changed the rules frequently and separated the seniority of the respondent on one cause or the other. The respondent had suffered the financial loss and expenses for coming to India from abroad to the tune of Rs.3,60,000. Hence, the complaint for installation of the tubewell connection, compensation for financial loss and compensation for mental tension, harassment, etc. Costs were also prayed.
(3.) THE appellants filed the written reply. It was admitted that the respondent had applied for tubewell electric connection under the Ex - servicemen priority category and he had submitted the test report on 15.6.2005 (15.6.2006). As per circular of the appellants No. 63/2008 dated 21.10.2008, the seniority of the respondent was at serial No. 64 as per the roaster for the month of February, 2009. However, as per the latest instructions of the appellants, overall priority is to be given to the pending test reports under the general category who had applied upto 31.12.1990.
