JUDGEMENT

(1.) THE first defendant in O.S.No.104 of 1988 on the file of the Sub Court, Ami who had lost before the first appellate court is the appellant in this Second Appeal. This Second Appeal is directed against the judgment and decree of the learned District Judge, North Arcot dated 30.11.1992 made in A.S.No.36 of 1992 in reversing the judgment and decree of the learned Subordinate Judge of Ami dated 31.3.1992 made in O.S.No.104 of 1988.

(2.) FOR convenience the parties shall be referred as arrayed before the trial court.

(3.) THE trial court framed six issues. Before the trial court, the plaintiff marked Exs.A-1 to A-31, while the defendants marked Exs.B-1 to B-33. THE plaintiff examined P.Ws.1 to 4, while the first defendant examined D.Ws.1 to 3.
