JUDGEMENT

(1.) This Writ Petition is filed for issuing a Writ of Certiorarified Mandamus, to quash the proceedings of the first respondent, dated 15.10.2013 and to direct the respondents to give all service benefits to the petitioner.

(2.) The petitioner was appointed as Junior Assistant in the Registration Department in the year 1995 and he was promoted as Assistant in the year 2002. The petitioner, while, working as Assistant at the Sub Registrar Office, Kalayarkovil, Sivagangai District, the Sub Registrar of Kalayarkovil, was on leave from 31.05.2010 to 07.06.2010. Therefore, the petitioner was in charge of the Office. On 31.05.2010, four documents were presented for registration, when the petitioner was incharge of the Office of Sub Registrar, Kalayarkovil.

The petitioner himself had some doubt about the genuineness of the transaction, as all those documents were executed through power of attorney, who was appointed by principals by document of power of attorney, which were registered twenty years back. While keeping the documents pending for scrutiny, the petitioner has made endorsement to the effect that accurate scrutiny is required to consider in what manner the power of attorney documents are executed and to what extent, the power is executed. The endorsement made by the petitioner in all the documents gives a clear impression that the petitioner wanted to scrutinise the documents in terms of Section 34 of Registration Act 1908, and Rule 55 of Rules framed under the Registration Act, 1908.
