JUDGEMENT

(1.) The petitioner has filed the present Writ Petition for issuance of a Writ of Certiorarified Mandamus, to quash the impugned order passed by the second respondent in Sl.No.631 of 2017, dated 11.12.2017 and consequently, direct the second respondent to remove the entry of the registration of the Marriage Certificate.

The case of the petitioner is that she had completed B.Sc Nursing Course in G.V.N College, Trichy in the year 2015 and she was working in G.V.N Multi-Speciality Hospital, Trichy and her friend one Aparna was also working in the said hospital. The said Aparna introduced the third respondent to the petitioner stating that he is her cousin and had a cordial relationship. Thereafter, the third respondent had proposed for marriage, but the petitioner refused to marry him. The petitioner further submitted that even though they are Hindus, they belong to different communities and hence, the petitioner refused that the marriage cannot be performed, but the third respondent forced the petitioner stating that he is in love with her and at one point of time, he started threatening her by stating that unless she marries him, he will commit suicide by writing a note stating that the petitioner has refused to marry him and she is the cause of his death.

The petitioner further submits that she informed the third respondent that their parents will not agree for the said marriage and he compelled that he would get consent from both the families including her father and relatives. The third respondent also convinced the petitioner stating that only after getting consent from both families, marriage should be registered in the second respondent office. The petitioner did not want to register the marriage, but the third respondent informed the petitioner that the Registration of Marriage would take place after three months from the date of presentation of the documents before the second respondent. In the meanwhile, the third respondent will get consent from both the families.
