JUDGEMENT

(1.) This petition has been filed to quash the First Information Report registered in Crime No.21 of 2019 pending on the file of the first respondent police.

(2.) The petitioners are accused Nos.1 to 5 in Crime No.21 of 2019, for the offences under Sections 342 , 384 , 506(ii) , 420 of the Indian Penal Code and Section 4 of the Tamil Nadu Prohibition of Charging Exorbitant Interest Act, 2003. The said crime has been registered based on the complaint given by the second respondent/defacto complainant alleging that he has borrowed money from the petitioners and he repaid the entire amount, despite the same, the petitioners are demanding exorbitant interest and also refusing to return the pronote, cheque leaves and other documents. Hence, the present complaint has been given. To quash the same, the present petition has been filed.

(3.) The learned counsel appearing for the petitioners as well as the learned counsel appearing for the second respondent submitted that now, the petitioners and the second respondent/defacto complainant have settled the dispute between themselves amicably and the petitioners also returned all the cheque leaves and other documents to the second respondent/defacto complainant. In the above circumstances, the second respondent/defacto complainant is not willing to proceed further with the criminal case.
