JUDGEMENT

(1.) The order issued by the Principal Secretary to the Government, Health and Family Welfare Department dated 25.11.2016 is under challenge in these present writ petitions.

(2.) The order states that the Drivers were appointed under the National Rural Health Mission for the purpose of assisting the delivered mothers in the Primary Health Centres. In other words, the delivered mothers in the Primary Health Centres are picked up and dropped by these drivers on trip basis.

(3.) The learned counsel for the writ petitioner states that the writ petitioners are working for a considerable length of time and therefore, they are entitled to be regularized in a sanctioned post on permanent basis. The writ petitioners were initially appointed on a consolidated pay and therefore, they are entitled to be regularized in the regular time scale of pay. On a perusal of the documents filed by the writ petitioners in the typed set of papers it is stated that the petitioners were appointed on daily wage basis as Drivers in Primary Health Centres of the Department of Health and Family Welfare. Undoubtedly, the wages were paid on monthly basis, however the engagement was on daily wage basis.
