S.SIVAKALAPERUMAL Vs. SECRETARY TO THE GOVERNMENT

Decided On January 21, 2019
S.Sivakalaperumal Appellant
V/S
SECRETARY TO THE GOVERNMENT Respondents

JUDGEMENT

(1.) The petitioner S.Sivakalaperumal argued his case in person.

(2.) It is not in dispute that the writ petitioner was appointed as BT Assistant in the 6th respondent school on 29.08.1983. It was a sanctioned post. He was promoted as Headmaster on 04.01.1989 overlooking the claims of the other senior staff in the school. Thereafter, controversy arose with regard to the continuance of the writ petitioner in the post of Headmaster. Claims and counter claims are being made as to what transpired between 1989-1990. Due to utter paucity of records, this Court is not in a position to pronounce anything definite on those developments.

(3.) The stand of the management is that the writ petitioner was unauthorisedly absent and was adopting an attitude of utter defiance and did not hand over the charge to J.Velaudham Pillai who was appointed as in-charge of the Headmaster in the place of the writ petitioner. The stand of the writ petitioner is that he was prevented from discharging his duty as in-charge Headmaster.
