M.DEVENDRAKUMAR Vs. COMMISSIONER OF POLICE

JUDGEMENT

(1.) This writ petition has been filed to quash the proceedings in order Na.Ka.No.20/19 dated 22.01.2019 passed by the second respondent and consequently, direct the respondents to grant permission to the petitioner- Political party to conduct a protest demonstration / agitation (Kandana Arbattam) using public address system from 11.00 to 13.00 hours on 25.01.2019 near Natraj Theatre, Palanganatham within the limits of the second respondent police Station and also to provide Police Protection to the said agitation, within a time limit to be fixed by this Court.

The learned counsel appearing for the petitioner would submit that the petitioner is the District President of Madurai City District Unit of People Liberation Party (having its Headquarters at West Urappanur) and would submit that the party is established with the motto of promoting Women Liberation, Community-free Society, Socialist World, Government for poor people and that they are undertaking the activities to protect the livelihood and welfare of poor people. Prime Minister of India has proposed to lay Foundation Stone for the establishment of All India Institute of Medical Sciences at Thoppur near Madurai on 27.01.2019. 3.The learned counsel for the petitioner would submit that the petitioner-party has proposed to conduct a protest demonstration / agitation under the leadership of the President of the said political party in a democratic manner condemning the Anti State Attitude of the Central Government near Natraj Theatre, Palanganatham on 25.01.2019 between 11.00 to 13.00 hours (2 hours), within the limit of third respondent police station and that they have sought for permission, whereas the respondent had rejected granting permission stating that they apprehend disturbance to law and order and in the interest of the public.
