JUDGEMENT

(1.) Heard Mr.M.Dennis Joe, learned counsel appearing for the petitioner and Mr.J.John Jeyakumar, learned counsel appearing for the respondent.

(2.) This petition has been filed against the order passed in I.A.No.163 of 2015 in O.S.No.96 of 2012 dated 06.08.2015 on the file of the learned Additional District Munsif, Eraniel.

(3.) The petitioner is the defendant and the respondent is the plaintiff in the suit. The respondent filed a suit in O.S.No.96 of 2012 before the learned District Munsif cum Judicial Magistrate, Eraniel for a prayer of injunction. In that suit, the respondent filed a petition in I.A.No.163 of 2015 under Order 6 Rule 17 of C.P.C., for permission to amend the plaint to include the prayer for declaration of title. That petition was allowed by the trial Judge. Against which, the petitioner has come forward with this revision petition.
