(1.) The writ petitioners were engaged as Mazdoors in the Scheme known as "National Malaria Eradication Scheme"?.

The learned counsel appearing for the writ petitioners states that the writ petitioners served as Mazdoors for a considerable length of time and therefore, they are entitled to permanent appointment in the time scale of pay. The learned counsel for the writ petitioners further states that the writ petitioners were employed in several Primary Health Centers under the supervision of the Health Inspectors in Ramanathapuram District. However, the writ petitioners were issued with fresh appointment orders each and every time showing that they were temporarily engaged as Mazdoors. Though the writ petitioners state that fresh appointment orders were issued each and every time to them, no such appointment orders are enclosed along with the typed set of papers filed in support of the present writ petition. However, it is an admitted fact that the writ petitioners were appointed as seasonal Mazdoors on temporary basis.

The learned counsel for the writ petitioners states that the respondents had considered the similarly placed employees and those employees were brought under the regular establishment in the regular time scale of pay. Thus, the case of the writ petitioners are also to be considered for grant of regularization and permanent absorption.
