M.MANGAYARKARASI Vs. PRINCIPAL SECRETARY TO GOVERNMENT

Decided On March 15, 2019
M.Mangayarkarasi Appellant
V/S
PRINCIPAL SECRETARY TO GOVERNMENT Respondents

JUDGEMENT

(1.) The relief as such sought for in the present writ petition is for a direction to direct the second respondent to consider the representation dated 12.07.2018 for employment of the petitioner's daughter on compassionate grounds.

(2.) The fact remains that the writ petitioner is the second wife of the Late Shri. A.Muniappan who was employed in the Veterinary department as Livestock Inspector Grade I at Kancheepuram. The deceased employee passed away on 03.06.2005, while he was in service. The first wife was having three daughters and the writ petitioner is the second wife of the deceased employee. The deceased employee married the writ petitioner after the death of the first wife and therefore, the marriage between the deceased employee and the writ petitioner was legal.

(3.) The learned counsel for the writ petitioner states that the writ petitioner seeks appointment on behalf of her daughter. The fact to be considered in this case is that the deceased employee passed away on 03.06.2005 and the application seeking compassionate appointment was considered and the proposal itself was submitted after a lapse of 12 years from the date of death of the deceased employee on 26.02.2018. The second respondent sent his letter during the month of December, 2018 stated that the proposal itself had sent by the authorities after a lapse of 12 years and the fact remains that the writ petitioner has not pursued the remedy within a reasonable period of time. If at all, the application submitted within a reasonable period of time, the applicant must pursue the remedy vehemently and approach the competent authorities as well as the Court of law within a reasonable period of time.
