JUDGEMENT

(1.) The petitioner filed this Writ Petition seeking direction, to call for the records relating to the impugned order vide proceeding No.O.Mu.No.6361/Kabi 1/3/2019 dated 26.08.2019 of the 3rd respondent and quash the same and consequently direct the respondent to sanction and reimburse the Medical expenses incurred by the petitioner with 9% interest.

(2.) Heard the learned counsel appearing for the petitioner and the learned Government Advocate appearing for the respondents. By consent, the writ petition is taken up for final disposal.

(3.) The case of the petitioner is that the petitioner retired from service and receiving pension. The Government of Tamil Nadu have introduced the Tamil Nadu Government Pensioners Health Fund Scheme, 1995 for the welfare of the retired State Government employees to meet out their medical expenses. Subsequently, the Tamil Nadu Government introduced New Health Insurance Scheme 2014 for pensioners (including spouse)/family pensioners. The petitioner is a subscriber to the above said scheme and the subscription of Rs.150/- is regularly deducted from his monthly pension. While so, on 20.07.2018, the petitioner was admitted on 20.07.2018 in the 5th respondent Hospital for diagnosis of Left Eye - Cataract and surgery with Oil implant. The petitioner underwent medical treatment in the said hospital from 20.07.2018 to 21.07.2018. The petitioner discharged and the hospital raised a bill for Rs.38,300/- and the 5 th respondent also advised the petitioner to come on 09.11.2018 to another surgery for Right Eye. Accordingly, the petitioner was admitted on 29.11.2018 in the 5th respondent Hospital for diagnosis of Right eye - Cataract and surgery was conducted Left Eye Phacoemulsification Cataract Surgery with Oil implant and the petitioner underwent medical treatment in the said hospital from 09.11.2018 to 10.11.2018 and the hospital raised a bill for Rs.38,300/- on 10.11.2018.
