JUDGEMENT

(1.) This writ petition has been filed to call for the records relating to the proceedings in Na.Ka.No.48/Na.Kaa.Va./Thiruvi/2018, dated 18.08.2018 on the file of the fourth respondent and quash the same as illegal and consequently directing the respondents to grant permission to the petitioner to conduct the Dravidar Kazhaga youth wing rally function and for public meeting at North Car Street, Thiruvilliputhur, scheduled to be held on 04.01.2019.

(2.) The learned counsel appearing for the petitioner would submit that the petitioner is the youth wing Scretary of Dravidar Kazhagam and also the District Reporter of "Viduthalai" Tamil Daily. He would further submit that Dravidar Kazhagam is a registered social organization having its Head Quarters at Chennai and it was founded by Thanthai Periyar. He would also submit that Thanthai Periyar formed Dravidar Kazhagam for reforming the society, eradication of superstitious belief, upliftment of the down trodden people and also for propagation of atheism and he was always fighting for fundamental rights of women which paved way for enactment of several women welfare laws and reforms and that after demise of the Thanthai Periyar, Dravidar Kazhagam is now headed by Thir.K.Veeramani as its President and that the Dravida Kazhagam for propagation of its ideology has been conducting functions, celebrations and conferences in a peaceful manner without any untoward incident.

The learned counsel appearing for the petitioner would submit that for conducting of similar programmes, the petitioner had given a representation to the fourth respondent on 16.08.2018 seeking permission to conduct a rally organized by Madurai Zone Dravidar Kazhaga Youth wing from the Statue of Great Leader Kamarajar to be proceeded towards Chinnakadai Bazaar and followed by the rally have decided to conduct public meeting at North Car Street, Thiruvilliputhur. He would further submit that the venue in which the petitioner has requested for permission to conduct the public meeting, is an approved place, where regular political and public meetings are conducted by all political parties and organizations and the respondent police has been regularly granting permission to all parties and organization. He would submit that very recently the respondent police has granted permission to several other parties to conduct meeting in the same place. While the petitioner was expecting that favorable orders will be passed by the respondent police, they have received the impugned order dated 18.08.2018 whereby the respondent had rejected their request for conducting meeting at the place.
