(1.) Aggrieved over the concurrent finding of the Courts below decreeing the suit filed filed for permanent injunction, this Second Appeal has been filed.
(2.) The parties are arrayed as per their own ranking before the trial Court.
(3.) The plaintiff has become the owner of the suit property by virtue of a settlement deed dtd. 30/11/1993 executed by his father and his grandmother. He is in possession and enjoyment of the suit property. Originally the suit property belong to his grandfather Parthasarathy. The plaintiff's father Durai is the only son to his grandfather and he is in continuous possession and enjoyment of the suit property for more than the statutory period. The plaintiff has also perfected his title by adverse possession. The defendant is residing in the north of the suit property and he is a stranger to the suit property and he has no right in the suit property. On 8/3/1997, the defendant tried to trespass into the suit property. At the timely intervention of villagers and elders it was prevented. Hence, the suit for permanent injunction.
