(1.) (Prayer: Civil Revision Petition is filed under Article 227 of Constitution of India, against O.P.No.917 of 2005 pending on the file of Second Additional Principal Judge, Family Court, Chennai. Heard the learned counsel appearing for the revision petitioner. The unfortunate husband/revision petitioner had filed O.P.No.3077 of 2007 before the Family Court, Chennai for divorce of his wife/respondent on the ground of cruelty. The grievance of the revision petitioner is that he had originally filed a petition for divorce in Andhra Pradesh under O.P.No.154/2005 and as a counterblast, the respondent had filed M.C.No.232 of 2005 under Section 125 Cr.P.C for maintenance and also she had filed O.P.No.917 of 2005 for restitution of conjugal rights. Since the O.P. for divorce filed by the petitioner was transferred to the Court at Tirupathi/Principal Senior Civil Judge, Tirupatti, the petitioner had filed divorce petition in O.P.No.3077 of 2007 before the Family Court, Madras after withdrewing H.M.O.P.No.33 of 2006 on the file of Principal Senior Civil Judge, Tirupatti, since the respondent had shifted her residence to Madras with her minor child. The grievance of the revision petitioner is that from 2007 onwards, the learned Judge of the Family Court is not taking up the matter giving unnecessary adjournments. The learned counsel would further represent that if the matter is taken up, then there is every possibility of settlement between the parties. Under such circumstances, this civil revision petition is disposed of with a direction to the Second Additional Judge, Family Court, Chennai to dispose of O.P.No.3077 of 2007 along with O.P.No.917 of 2005 and M.C.No.232 of 2005 within a period of six weeks from the date of receipt of a copy of this order.
