JUDGEMENT

(1.) These appeals are preferred against the conviction and sentences of the Special Judge, Tiruchirapalli in C.C. No.1 of 1978 for offences under sections 120-B and 161 I.P.C. and 5(1)(a) and 5(1)(d) read with section 5(2) of the Prevention of Corruption Act.

(2.) The first appellant in C.A. No. 115 of 1984 is A-1 in the case and will be hereinafter referred to as Pt accused. The second appellant is 3rd accused and will be hereinafter referred to as 3rd accused. The appellant in C.A. No. 572 of 1984 is 2nd accused in the case and will be hereinafter referred to as 2nd accused.

(3.) Facts briefly are: The accused were tried for the above offences on the allegation that between November 1975 and March 1976 they being public servants, Pt accused being the Sorter in Railway Mail Service, Madras, sorting division at Madras, 2nd accused being Mail man, Railway Mail Service, Tiruchirapalli and 3rd accused being Sorter, Railway Mail Service, Tiruchirapalli entered into a conspiracy: abusing their official position to hold out to unemployed persons residing in and around Lalgudi Taluk, Tiruchirapalli District that they would secure jobs for them in the Posts and Telegraphs Department as Supervisors, Telephone Operators and Line men and demanded and accepted illegal gratification from several such persons and had thereby committed the above offences.
