JUDGEMENT

(1.) The petitioner seeks for a Writ of Mandamus, directing the respondent to permit the petitioner to participate in the physical selection scheduled on 02.09.2018 under the common recruitment for Police Constable, Jail Warder and Firemen, 2018 under Sports/MBC quota and consequently, direct the respondent to include the petitioner's name in the Provisional Selection List (Centre Code-24, Madurai) issued by the respondent office dated 11.08.2018.

The case of the Petitioner is that pursuant to the advertisement for the post of common recruitment of Police Constable, Jail Warder and Firemen, 2018, he has applied for the said post under sports category. He attended the written test on 11.03.2018 and has secured 40 marks out of 80. On 11.08.2018, the provisional selection list was issued by the respondent, wherein the name of the petitioner did not find place.

(3.) According to the petitioner one Aravinthan, who has secured 32 marks, was selected by the respondent under sports quota (Men), belonging to Most Backward Class(MBC) category. The case of the petitioner is that he was not considered even though he also belongs to the very same category, namely, MBC and also secured higher marks in the written test. Pursuant to the discrimination shown by the respondent, the petitioner has come forward with the present writ petition seeking for the above direction.
