JUDGEMENT

(1.) The order of rejection dated 21.08.2010 passed by the respondent, in relation to the claim of compassionate appointment made by the writ petitioner is under challenge in this writ petition.

(2.) Heard, M/s. T. Banumathy, learned counsel appearing for the petitioner and Mr.P.Srinivas, learned counsel appearing for the respondent.

The learned counsel appearing for the petitioner strenuously contended that the father of the writ petitioner was employed as Sanitary cleaner and passed away on 21.11.1999, while he was in service. Even at the time of the demise of her father, the writ petitioner was a married daughter and no application seeking compassionate appointment was submitted and soon after the death of the petitioner's mother on 07.11.2005, only the application for compassionate appointment was submitted. The learned counsel for the petitioner made a submission that the brother of the writ petitioner had initially submitted an application seeking compassionate appointment. However, the same was not considered and the brother also expired on 27.06.2009. Thereafter the writ petitioner made an application seeking compassionate appointment on 22.07.2009. The said application was rejected by the respondent vide proceeding dated 21.08.2010. The reasons stated in the rejection order is that the writ petitioner was a married daughter at the time of the death of the deceased employee and she had got a decree of divorce which was obtained only on 01.09.2009, after a lapse of four years from the date of death of the deceased employee. Therefore the claim of the writ petitioner cannot be considered.
