JUDGEMENT

(1.) This appeal is filed under Section 378 Cr.P.C praying to set aside the order of acquittal passed by the learned Judicial Magistrate No.II, Srivilliputhur in C.C.No. 133 of 2006 on 26.09.2007.

(3.) In the Trial Court, one witness was examined, on the side of the appellants Exs.P1 to Ex.P11 were marked. The accused examined himself and marked Exs.D1 to Ex.D After full contest, the learned Judicial Magistrate No.II, Srivilliputhur, dismissed the complaint and acquitted the accused under Section 255 (1) Cr.P.C on the following grounds:-
