The petitioner has come forward with the present Writ Petition seeking for issuance of a Writ of Mandamus, directing the second respondent Company to disburse the entire amount, as agreed on 06.03.2008 which comprises enhanced land value, as per order in L.A.O.P.No.39 of 1991 along with statutory benefits including 30% solatium, 12% additional amount, 9 & 15% interest upon the enhanced land value as well as solatium and additional amount, as laid in Supreme Court decision reported in 2001(4) CTC 434.
(2.) Heard the learned counsel for the petitioner, the learned Government Advocate appearing for the respondents 1 and 3 and the learned counsel appearing for the second respondent. 3. In similar circumstances, this Court dealt with the very same issue with respect to the other land losers in Writ Petition (MD) Nos.2089, 2090, 3464, 3851 and 3852 of 2009 and disposed of the Writ Petitions on 26.04.2011, by observing as follows: "These writ petitions at the instance of the displaced land owners seek a writ of Mandamus to direct the requisitioning body to disburse the statutory benefits in accordance with the judgment of the Supreme Court in Sunder v. Union of India, (2001) 7 SCC 211.
(3.) The petitioners in the other writ petitions are similarly placed and as such, they also wanted the Company to pay them the statutory benefits.
