JUDGEMENT

(1.) Mr.T.Sivanandan, has filed two writ petitions. W.P.No.10430 of 2015 has been filed by him seeking to quash the impugned proceedings dated 30.09.2013 passed by the Tamil Nadu Public Service Commission (TNPSC), in and by which, the TNPSC has invalidated his answer sheet relating to the written examination held on 26.08.2012 for the post of Motor Vehicle Inspector, Grade-II, on the ground that the petitioner had chosen the subject 'Automobile Engineering', instead of Mechanical Engineering the subject in which he studied and that the said action of the petitioner is in contradiction to Note (i) of Paragraph No.6 of the Notification dated 25.06.2012, which specifically states to choose only the subject in which they have obtained the prescribed qualification.

(2.) W.P.No.34846 of 2016 has been filed by him seeking for a direction to the TNPSC to reassess the correct answers given by him for question Nos.1, 149, 171 and 194 in Question Serial Numbers 20,000 389, DEAE 2012 and thereby award him full marks and conduct the interview to him for the post of Motor Vehicle Inspector Grade-II.

Mr.R.Thiagarajan, learned Senior Counsel, appearing for the petitioner, submitted that the petitioner had passed the in the year 1987 and subsequently, in the year 1989, he had also acquired the Post Graduate Diploma in Automobile Engineering. In addition to this, he also possesses the driving license in (i) Light Motor Vehicle (ii) Motor Cycle with gear (iii) Heavy Transport Vehicle (iv) Driving Experience of 6 years both in heavy goods vehicle and heavy passenger motor vehicle and (v) also possessing 3 years of working experience in a reputed automobile workshop. With these qualifications, he applied for the post of Motor Vehicle Inspector Grade-II pursuant to the Notification dated 25.06.2012 issued by the TNPSC inviting applications through online to fill up 17 vacancies of the said post. Paragraph 4(b) of the said Notification deals with the educational qualification for the said post which is stated below:-
