(1.) For the sake of convenience, the parties will be referred to by their name.
(2.) Revathi got married to Karthikeyan on 210.2007 and they have two children through the wedlock. Their marriage ran into rough weather resulting in the spouses getting estranged. On the complaint lodged by Revathi, the Inspector of Police, All Women Police Station, Dindigul, registered a case in Crime No.17 of 2012 against Karthikeyan and his parents for the offences under Sections 498(A) of the Indian Penal Code and Section 4 of Tamil Nadu Prohibition of Women Harassment Act and after completing the investigation, filed a charge sheet in C.C.No.184 of 2012 before the learned Judicial Magistrate No.2, Dindigul, in which, the accused were acquitted by the Trial Court on 005.2017. During the pendency of the trial, Revathi initiated proceedings under the Domestic Violence Act in D.V.O.P.No.7 of 2015 before the learned Judicial Magistrate No.I, Dindigul, claiming various reliefs including monthly maintenance. On notice, Karthikeyan and his parents entered appearance and contested the case. On behalf of Revathi, she examined herself as P.W.1 and also examined one Santhalakshmi as P.W. Six Exhibits, namely Exs.P.1 to P.6 were marked on her side. Karthikeyan examined himself as R.W.1 and one Venugopal was examined as R.W. One Exhibit namely Ex.R.1 was marked on behalf of Karthikeyan. After considering the evidence adduced by both sides, the Trial Court, by order dated 10.03.2017, in D.V.O.P.No.7 of 2015, directed Karthikeyan to pay Rs.4,000/- per month as maintenance to Revathi and her two minor children and also Rs.1,000/- per month towards house rent. Aggrieved by the order, Karthikeyan filed C.A.No.52 of 2017 before the Principal Sessions Court, Dindigul. The learned Principal Sessions Judge, Dindigul, heard both sides and dismissed C.A.No.52 of 2017 on 07.09.2017, aggrieved by which, Karthikeyan and his parents are before this Court.
(3.) Initially, Karthikeyan had engaged advocates Mr.Karthick Subramanian and Mr.S.Krishnan to represent him. During the course of the proceedings, he withdrew the vakalat that was given to the counsel and appeared as party-in- person. On behalf of Revathi, Mr.M.Siddharthan, learned counsel has entered appearance.
