JUDGEMENT

(1.) The above Civil Revision Petition is filed by the first defendant challenging the order dated 17.10.2008 passed by the First Additional District Judge, Coimbatore in I.A.No.766 of 2006 in O.S.No.497 of 2004 in and by which the learned Judge has dismissed the application filed by the first defendant seeking to reject the plaint under Order VII Rule 11 (a) (d) of the Code of Civil Procedure.

(3.) On receiving receipt of notice in the above suit the revision petitioner filed an application to reject the plaint. The rejection was sought on the ground that the suit does not disclose a cause of action for the following reasons.
