JUDGEMENT

(1.) WHEN the matter was called, the learned counsel for the petitioner submitted that he may be permitted to withdraw this Second Appeal, since the matter was settled out of Court and he has also made an endorsement to that effect.

(2.) IN view of the above submission made by the counsel for the petitioner, this Second Appeal is dismissed as settled out of Court. No order as to costs.
