JUDGEMENT

(1.) The learned Additional Public Prosecutor submitted that though the counter affidavit has not been filed, the proforma has been available and he has agreed to make his submissions based on the said proforma.

(2.) The petitioner is the mother of the detenu. The detenu aged about 25 years has been detained by the second respondent by his order in M.H.S.Confdl. No.175/2016 dated 09.12.2016, holding him to be a "Sand Offender", as contemplated under Section 2(gg) of Tamil Nadu Act 14 of 1982. The said order is under challenge in this Habeas Corpus Petition.

(3.) We have heard the learned counsel for the petitioner and the learned Additional Public Prosecutor for the respondents. We have also perused the records produced by the Detaining Authority.
