(1.) The order of rejection issued by the second respondent respondent in proceedings dated 15.2.2006, is under challenge in this writ petition.

The learned counsel appearing for the writ petitioner made a submission that the father of the writ petitioner was employed as a Driver in the Tamil Nadu Electricity Board and passed away on 10.8.1991, while he was in service. The mother of the writ petitioner submitted an application seeking compassionate appointment on 25.9.1991. However, the same was not considered on the ground that the mother was not possessing the requisite educational qualification of pass in 8th Standard. Thereafter, another application was submitted only on 23.1.2006 after a lapse of about 15 years from the date of death of the deceased employee.

On a perusal of the impugned order it is stated that the application submitted by the writ petitioner was not submitted in accordance with the terms and conditions of the scheme of compassionate appointment and accordingly the same cannot be considered. Thus, the fact remains that application seeking compassionate appointment though initially submitted in the year 1991 and thereafter on 23.1.2006 after a lapse of 15 years. The application initially submitted in the year 1991 was not pursued till 2006. Thus the family of the writ petitioner has not pursued the application seeking compassionate appointment diligently and within a reasonable period of time. Under these circumstances now after a lapse of about 26 years from the date of death of the deceased employee, this Court is not inclined to consider the claim of the writ petitioner for extending the benefit of scheme of compassionate appointment.
