JUDGEMENT

(1.) HEARD the learned counsel appearing for the petitioner as well as the learned Senior Counsel appearing for the contesting first respondent in both the revisions.

(2.) MR. GANDHI, learned Senior Counsel appearing for the contesting first respondent in both the revisions fairly states that the impugned orders of the Debts Recovery appellate Tribunal, Chennai are to be quashed and in turn, seeks direction to the said authority for early disposal of the Miscellaneous Appeals (yet to be numbered ).

(3.) THE above statement is hereby recorded. Accordingly, while setting aside the order dated 24. 01. 2007 passed in I. A. Nos. 51 and 52 of 2007 in IN Nos. 43 and 44 of 2007 in M. A. Nos. (yet to be numbered), the Debts Recovery appellate Tribunal is directed to dispose of the unnumbered miscellaneous appeals filed by the first respondent herein on merits, within a period of four weeks from the date of receipt of a copy of this order. It is made clear that since the petitioner in these revisions is not a party before the Debts Recovery Appellate Tribunal, he is free to file a proper application for impleading himself and if any such application is filed, the Debts Recovery Appellate tribunal is free to consider and pass appropriate orders, permitting him to participate in the said proceedings. It is further made clear that we have not expressed anything on merits of any one of the parties and it is for them to establish before the appropriate forum, by letting acceptable materials. With the above observation/direction, both the civil revision petitions are disposed of. No costs. Consequently, connected miscellaneous petitions are closed.
