JUDGEMENT

(1.) The sole accused in a case of murder, who stood charged under Sections 307 and 302 IPC, tried, found guilty under Sections 324 and 302 IPC and was sentenced to undergo life imprisonment and to pay a fine of Rs. 2000/-, in default to undergo RI for one year under Section 302 IPC and was also sentenced to undergo two years RI under Section 324 IPC, has brought forth this appeal from the judgment of the learned Principal Sessions Judge, Madurai made in S.C. No. 630 of 2004.

(2.) The short facts necessary for the disposal of this appeal can be stated thus:

(3.) The case was committed to the court of Sessions and necessary charges were framed. In order to substantiate the charges, the prosecution has examined 13 witnesses and relied on 22 exhibits and also 8 M.Os. On completion of the evidence on the side of the prosecution, the accused was questioned under Section 313 Cr.P.C as to the incriminating circumstances found in the evidence of prosecution witnesses, which he flatly denied as false. No defence witness was examined. On completion of the trial, the trial court heard the arguments advanced on either side and scrutinised the materials available and has found the appellant/accused guilty as per the charge of murder and awarded life imprisonment and in respect of the other charge, he was found guilty under Section 324 IPC and was awarded imprisonment, as referred to above. Hence, this appeal has been brought forth before this Court.
