SASI Vs. COMMISSIONER OF POLICE TAMBRAM, CHENNAI

JUDGEMENT

(1.) The Writ of Habeas Corpus Petition is filed seeking a direction to the second respondent-Police to produce the petitioner's minor daughter xxxxxx, D/o.Mari, aged about 16 years, presently under the illegal custody of the 3rd respondent, before this Court and hand over her custody to the petitioner herein.

(2.) It is the case of the petitioner that her minor daughter viz., xxxxxx, D/o.Mani, aged about 16 years has been illegally detained by the third respondent on 31/12/2025, and hence, she lodged a complaint before the second respondent-Police on 1/1/2026. Pursuant to which, a case in Crime No.4 of 2026 was registered for "Girl Missing", but no action was taken till date, the present petition is before this Court.

(3.) The learned Additional Public Prosecutor appearing for the respondents-Police, submitted that the respondents-Police, on instructions, submitted that it is the case of the petitioner that her daughter was allegedly abducted by the third respondent, who is working as a teacher in the school where the petitioner's daughter was studying, by taking her in an auto rickshaw. He further submitted that after registering the complaint, the Police have taking all effective steps to trace the detenue and the third respondent, including conducting enquiries, verifying possible locations and examining relevant persons connected with the case.
